Course terms & conditions
Rules for registration, payment and participation in Oleksy-Sport courses.
§ 1. General Provisions
The training courses are organised by Oleksy-Sport, with its registered office at 25 Klementyny Hoffmanowej Street, 35-016 Rzeszów, Poland, hereinafter referred to as the “Organiser”.
These Terms and Conditions set out the rules governing registration for and participation in in-person training courses organised by the Organiser.
A person registering for a training course, hereinafter referred to as the “Participant”, is required to read these Terms and Conditions before submitting their registration.
By submitting a registration and accepting these Terms and Conditions, the Participant confirms that they have read and understood their content and agree to comply with the rules set out herein.
§ 2. Registration and Conclusion of the Agreement
Registration for a training course is completed using the form available at oleksy-sport.pl.
The number of places is limited. Places are allocated according to the order in which registrations and payments are received.
To reserve a place, the Participant is required to pay a deposit of PLN 500 within 5 business days of submitting their registration. The deposit must be paid into the following bank account: 95 1020 4391 0000 6802 0158 0018.
The payment date is deemed to be the date on which the funds are credited to the Organiser’s bank account.
Payment of the PLN 500 deposit:
a) guarantees the Participant a reserved place on the selected training course;
b) is credited towards the total price of the training course;
c) secures the performance of the agreement and the Organiser’s readiness to deliver the training course;
d) does not yet constitute final confirmation of participation in the training course.
Participation is finally confirmed once the full price of the training course, comprising the deposit and the remaining amount due, has been credited to the Organiser’s bank account within the deadline specified by the Organiser.
The Organiser will send confirmation of the reservation to the Participant once the deposit has been credited to the Organiser’s bank account. If the deposit is not credited within the specified period, the Organiser may cancel the registration or allocate the place to another person.
A person who has submitted a registration but has not paid the deposit may be placed on a waiting list.
If all available places have been filled, the Organiser may refuse to accept a registration. Any payment made after all places have been filled will be refunded to the account from which it was made, unless the Participant agrees to transfer the payment to another training course.
§ 3. Payment
The price applicable to each training course date is stated on the relevant training course webpage.
Payment for the training course is made in two instalments:
a) a deposit of PLN 500;
b) a second instalment equal to the difference between the total price of the training course and the deposit already paid.
The second instalment must be paid by the deadline specified by the Organiser in a message sent to the Participant. Unless the Organiser specifies a different deadline, the second instalment must be credited to the Organiser’s bank account no later than 21 days before the training course begins.
The Organiser may set a different deadline for payment of the second instalment, particularly when registration takes place fewer than 21 days before the training course begins.
If a registration is submitted after the deadline for payment of the second instalment, the Organiser may require the full price of the training course to be paid immediately.
Participation is finally confirmed only once the full price of the training course has been credited to the Organiser’s bank account.
Failure to pay the second instalment within the specified period may result in:
a) cancellation of the reservation;
b) removal of the Participant from the list of participants;
c) allocation of the vacant place to another person.
A Participant who requires an invoice must provide all the information necessary for its issue no later than before making the payment or within the deadline specified by the Organiser.
The price includes the services specified in the offer for the relevant training course, in particular:
a) participation in the classes;
b) training materials, where provided;
c) a certificate of participation;
d) access to the equipment used during the classes;
e) refreshments or beverages.
The price does not include the costs of:
a) travel;
b) accommodation;
c) parking;
d) meals;
e) insurance for the Participant.
§ 4. Cancellation of a Training Course
The Organiser reserves the right to cancel a training course or change its date for organisational reasons, including, in particular, an insufficient number of participants or the illness of the instructor.
If a training course is cancelled, the Participant may choose:
a) a refund of the amount paid;
b) transfer of the full amount paid to a new date of the training course;
c) transfer of the full amount paid to another training course available from the Organiser, subject to agreement on how any difference in price will be settled.
If the Participant chooses a refund, the Organiser will issue it to the account from which the payment was made or to another account specified by the Participant.
If the training course is cancelled for reasons for which the Organiser is responsible, the deposit will be settled in accordance with the applicable provisions of law governing deposits.
The Organiser does not reimburse any expenses incurred independently by the Participant in connection with their intended participation in the training course, including, in particular, the costs of:
a) travel;
b) flights;
c) accommodation;
d) meals;
e) loss of earnings.
§ 5. Withdrawal and Refunds
The Participant may withdraw from the training course without providing a reason no later than 14 days before it begins. In such a case, the Organiser will refund the amount paid by the Participant, less the PLN 500 deposit.
If the Participant withdraws fewer than 14 days before the training course begins, the Organiser will refund 50% of the amount paid in excess of the deposit. The PLN 500 deposit is non-refundable.
Withdrawal on the day of the training course or the Participant’s failure to attend does not entitle the Participant to a refund.
Instead of withdrawing, the Participant may nominate another person to attend the training course in their place at no additional cost. The Organiser must be notified in advance of any change of Participant.
Withdrawal or a change of Participant must be reported electronically to the Organiser’s email address.
§ 6. Organisation of the Training Course
The training course includes both theoretical and practical components. The Participant is required to bring clothing suitable for participation in the practical component.
The Participant will receive training materials and a personalised certificate of participation in the training course.
The training materials are protected by copyright and are intended solely for the Participant’s personal use.
Without the prior consent of the Organiser or the author, it is prohibited to:
a) copy or distribute the materials;
b) make the materials available to third parties;
c) publish the materials online;
d) sell or use the materials for commercial purposes;
e) conduct other training courses based on the materials;
f) remove any markings identifying the author or the Organiser.
The Participant does not acquire any copyright or licence permitting the commercial use of the materials. Any infringement of copyright may result in liability under the applicable provisions of law.
Recording all or any part of the training course in audio or video form requires the Organiser’s prior consent.
§ 7. Personal Data
The Organiser is the controller of the Participants’ personal data.
Personal data is processed for the purposes of handling registrations, delivering the training course and issuing certificates and, subject to separate consent, for information and marketing purposes.
In accordance with the applicable provisions of law, the Participant has the right to access, rectify and erase their personal data, restrict its processing and object to its processing.
For matters relating to the processing of personal data, the Organiser may be contacted at: info@oleksy-sport.pl.
§ 8. Final Provisions
Any matters not covered by these Terms and Conditions are governed by Polish law, in particular the provisions of the Polish Civil Code and the Polish Consumer Rights Act.
These Terms and Conditions take effect on the date of their publication at oleksy-sport.pl.
